Subscription Terms

These Subscription Terms apply to purchases of subscription-based software and services from We Are Falcon ApS (the “Company”, “we”, “us”, “our”) via wearefalcon.tv and any related checkout pages (the “Website”). They supplement our general Terms and Conditions. If there is a conflict between these Subscription Terms and our general Terms and Conditions, these Subscription Terms apply for subscription purchases.

2. Scope and definitions

These Subscription Terms apply when you purchase a subscription plan for our software and services (a “Subscription”). A Subscription is a recurring payment arrangement billed at a fixed interval (for example monthly, quarterly, semi-annual, or annual), as shown in checkout and/or on the product page.

“You” means the customer purchasing the Subscription, either as a consumer or on behalf of a business.

 

 

3. Subscribing and account access

You create a Subscription by selecting a subscription plan and completing checkout. Your Subscription becomes active when payment is successfully authorised and you receive an order confirmation.

Access to the subscription service may require an account. You are responsible for keeping your login credentials confidential and for activity occurring under your account.

 

 

4. Prices, taxes, and what you are buying

The price, billing interval, included features, and any usage limits are displayed on the product page and/or in checkout before purchase. Prices may be shown inclusive or exclusive of VAT or other taxes depending on your customer type and location. Any applicable taxes are calculated and displayed during checkout.

 

 

5. Recurring billing authorisation

By purchasing a Subscription, you authorise us, through our payment providers, to charge your chosen payment method on a recurring basis according to the selected billing interval until you cancel. This authorisation covers each renewal payment and any applicable taxes.

 

6. Billing timing and renewals

Initial payment is charged at the time you start your Subscription unless checkout clearly states otherwise.

Renewals occur automatically at the start of each new billing period, using the payment method on file. The renewal date and billing interval are defined by the plan you select.

We may issue invoices or receipts electronically, typically by email and/or through your account area if available.

 

7. Payment method storage and security

To enable recurring billing, our payment providers store a secure payment token or reference associated with your payment method. We do not store full card details on our own systems. Payment processing is handled by providers operating in accordance with relevant security standards (such as PCI DSS).

 

 

8. Failed payments and suspension

If a payment fails, we may retry the charge within a reasonable period. If payment remains unsuccessful, we may suspend or limit access to the subscription service until payment is completed.

If your Subscription is suspended for non-payment, you remain responsible for any outstanding amounts for periods already billed or due under your Subscription.

 

9. Cancellation

You can cancel your Subscription at any time. Unless stated otherwise on the product page or in checkout, cancellation takes effect at the end of the current paid billing period. You will retain access until that period ends.

  • By contacting us at hello@wearefalcon.tv and providing the email address used for purchase and your order details.

 

 

10. Refunds

Unless mandatory law requires otherwise, subscription payments are non-refundable once a billing period has started. If you cancel, you will not be charged for the next billing period.

If you believe you were charged in error, contact hello@wearefalcon.tv promptly with your order details so we can investigate.

 

 

11. Plan changes (upgrades and downgrades)

If you change your plan, the effective date and any price adjustment will be shown at the time of change. Depending on the plan and system configuration, changes may apply immediately or from the next renewal date. Where relevant, we may apply prorated charges or credits, which will be disclosed at the time you make the change.

 

 

12. Price changes and changes to Subscription Terms

We may change subscription prices or these Subscription Terms. If a change affects your Subscription, we will provide notice in reasonable time before it takes effect, typically by email and/or via the Website or your account.

If you do not agree to a change, you may cancel your Subscription before the change takes effect. Continued use after the effective date constitutes acceptance of the change.

 

13. Digital services and consumer right of withdrawal

If you are a consumer in the EU/EEA: when you purchase a digital service and request that delivery begins immediately, you acknowledge that the statutory right of withdrawal may be lost once the performance of the service has begun, to the extent permitted by applicable law. If you are presented with a consent checkbox in checkout regarding immediate delivery, that checkbox governs.

 

 

14. Fair use, misuse, and compliance

You must use the subscription service in accordance with applicable law and our acceptable use rules (if published). We may suspend or terminate access if we reasonably believe there is fraud, misuse, or a material breach of our terms.

 

 

15. Termination by us

We may terminate a Subscription with notice if required for legal, security, or operational reasons, or if you materially breach these terms. If we terminate without cause, we will typically allow access until the end of the paid billing period or provide a pro-rated refund where required by law.
