We Are Falcon sells both software solutions for the media and broadcast industry, including Falcon Rundown, Falcon Play and related applications, as well as selected hardware and accessories via our webshop.

By placing an order on our website, you accept these Terms and Conditions.


2. Scope
These Terms and Conditions apply to all purchases made on our website, including
• subscriptions and software licenses
• physical products and hardware
• upgrades, renewals and additional services

For business customers, additional written agreements or contracts may supplement these Terms.


3. Products and Licenses

 

3.1 Software and subscriptions
We Are Falcon sells software as subscription based services. A valid subscription grants access to the software for the paid period. License keys and access are delivered digitally. Some license types may be hardware bound.

Licenses may not be resold, transferred or shared with third parties without written consent from We Are Falcon.


3.2 Hardware and physical products
We also sell selected hardware and accessories that complement our software solutions, for example computers, servers, DeckLink cards or other equipment. Product descriptions, specifications and prices are shown on the product pages.

There may be limited stock or delivery times on certain items. If a product is sold out or unavailable, we will contact you to agree on a solution, such as a new delivery date, an alternative product or cancellation.


4. Ordering Process and Contract Formation
When you place an order in the webshop, the process is typically as follows

  1. You add one or more products to the cart from the product pages.

  2. You go to the checkout, enter billing and shipping information and accept these Terms and Conditions.

  3. You choose payment method and confirm the order. If you pay by card, you are redirected to a secure payment window.

  4. After the order is placed, you receive an email confirming that we have received your order. This is only a receipt for your request.

  5. The final binding agreement is formed when you receive an order confirmation from us. Until you receive this, We Are Falcon may cancel the order in full or in part, for example in case of obvious price or text errors or if a product is sold out. If this happens, you will be contacted.

5. Prices
All prices on the website are shown in Danish kroner. Unless otherwise stated, prices are inclusive of 25 percent Danish VAT and exclusive of any shipping costs.

Prices are daily prices and may be changed without prior notice. The price applicable is the price shown at the time of ordering.

Any shipping costs are shown clearly during checkout before you complete the purchase.


6. Payment
On our website you can pay with payment cards
• Visa
• Mastercard

We do not charge separate card fees. The amount is only charged to your card when
• in the case of physical products, the order is shipped
• in the case of software, access or license is delivered or activated

If you pay with an international payment card, the amount may be reserved on your account by your card issuer until we capture the payment in connection with shipment or activation.

Payment is handled via a secure PCI DSS compliant payment gateway.

If payment fails or is rejected, we are not obliged to deliver the order.


7. Delivery and Shipping of Hardware

 

7.1 Delivery methods


For hardware and physical products, we offer delivery via parcel service or courier to parcel shop, business address or private address, as specified during checkout.

Available shipping options and prices are shown before you complete the purchase.


7.2 Delivery time
Typical delivery time within Denmark is 1 to 3 business days from the time the order is shipped, unless otherwise stated on the product page or in the order confirmation.

If a product has a longer delivery time or is on backorder, this will either be shown on the product page or communicated directly after your order.


7.3 Risk of goods
The risk for the goods passes to you at the time of delivery. If the parcel is visibly damaged on arrival, you should note this with the carrier and contact us as soon as possible.


8. Delivery of Software and Digital Products
Software, licenses and subscriptions are delivered digitally, typically by


• email with activation information and license key
• creation of user account and access to an online portal
• activation directly in We Are Falcon systems

Delivery is considered completed when access information has been sent to the email address you provided or when the software has been activated for your account.


9. Right of Withdrawal


9.1 Physical products and hardware



As a consumer you have a 14 day right of withdrawal on physical products purchased online. The withdrawal period runs from the day you
• receive the product
or
• receive the last item in an order with several items delivered individually
or
• receive the last part in the case of a product delivered in several lots or parts


To exercise the right of withdrawal, you must clearly notify us within 14 days from receipt that you wish to cancel your purchase. You can do this by email to hello@wearefalcon.tv, including your order number and a clear statement that you wish to withdraw.

You then have 14 days from the date you notified us to return the product to us. You must pay the direct cost of returning the product. You are responsible for the product from the time you receive it and during return shipment, and you must ensure safe and proper packaging.

You cannot withdraw from the purchase simply by refusing to receive the parcel without notifying us.


The product should if possible be returned in original packaging, as missing or damaged original packaging may reduce the value.

You are liable for any reduction in the value of the product that is due to handling other than what is necessary to determine the nature, characteristics and functioning of the product. You may handle the product in the same way as in a physical store but may not put it into actual use.

If the product has been used more than described above, we reserve the right to reduce the refund amount to reflect the diminished value.

When we receive the product and have inspected it, we refund the purchase price for the product, less any value reduction. We also refund the original delivery cost corresponding to our cheapest standard delivery option, unless the withdrawal only concerns part of the order. Return shipping from you to us is not refunded.


Refund will be made without undue delay and no later than 14 days after we have been notified of your decision to withdraw, but we may withhold the refund until we have received the goods or you have provided documentation that they have been returned.

Refund is made to the same payment method that you used for the original transaction unless otherwise agreed.


9.2 Software and subscriptions
For software, digital products and subscriptions that are delivered and activated immediately, the right of withdrawal is waived once you have accessed or activated the software.

If a software license has been purchased but not yet activated, you may withdraw the purchase within 14 days by contacting us in writing.



10. Warranty and Complaints

 

10.1 Consumer purchases of hardware

When you purchase hardware as a consumer, the rules of the Danish Sale of Goods Act apply, including a two year complaint period for defects.

If there is a defect in the product, such as a manufacturing or material defect, you may have the right to repair, replacement, price reduction or refund, depending on the specific situation.

It is a requirement that the complaint is justified and that the defect is not due to incorrect use, accidental damage or other damage causing behaviour.

You must complain within a reasonable time after you have discovered the defect. Complaints made within two months after the defect is discovered are always considered timely.

If the complaint is justified, we will refund your reasonable shipping costs. The product must be returned in safe packaging, and you should keep the shipping receipt.

Please contact hello@wearefalcon.tv before returning defective hardware and include a detailed description of the problem and your order number.


10.2 Software and services


For software and digital services, we strive to correct bugs and errors within reasonable timeframes. If you experience errors that significantly affect the use of the software, please contact our support team. Your rights follow from the contract and applicable law.

Normal wear and tear and performance limitations related to configuration, third party software or network conditions are not considered defects.


11. Limitation of Liability
We Are Falcon is not liable for indirect losses, loss of profits, operational interruptions, loss of data or other consequential damages.

For direct losses, any liability is limited to an amount equal to the total fees paid by the customer to We Are Falcon during the last six months prior to the claim.


Nothing in these Terms excludes liability where such exclusion is not permitted under mandatory Danish law.


12. Special Conditions for Business Customers
A business purchase is defined as a purchase where the invoice is issued to a company. For business customers

• the right of withdrawal does not apply unless explicitly agreed
• complaint handling follows Danish law, but with a focus on repair and replacement as primary remedies
• We Are Falcon retains title to the goods until full payment has been received
• any agreed credit may be subject to interest and fees in case of late payment

Any special terms for business customers will appear from the quotation, order confirmation or contract.


13. Data Protection and Cookies
We Are Falcon processes personal data in accordance with applicable data protection legislation. We collect and store only the information necessary to process your order, manage your account and provide our services.

14. Data Security
We recommend that all customers make regular backups of important data. We Are Falcon cannot be held responsible for loss of data or other indirect consequences caused by the use of our products, unless this follows directly from mandatory Danish law.


15. Force Majeure
We Are Falcon is not liable for delays or failure to perform obligations if this is due to events beyond our reasonable control, such as strikes, lockouts, war, terrorism, natural disasters, pandemics, breakdown of communication systems or similar circumstances. In such cases, our obligations are suspended for the duration of the force majeure situation.


16. Complaints and Dispute Resolution
If you as a consumer wish to complain about a purchase, you should first contact We Are Falcon at hello@wearefalcon.tv.

If we are not able to find a solution, you may, if the conditions are met, bring the case before the relevant complaint body in Denmark or use the EU online dispute resolution platform.

17. Governing Law and Venue
These Terms and Conditions are governed by Danish law. Any dispute that cannot be resolved amicably shall be brought before the courts in Copenhagen, Denmark.
